SIMPLYSUITS LTD
TERMS AND CONDITIONS OF HIRE
This contract states the terms and conditions by which we, SIMPLYSUITS LTD, (SS) agree to provide you, the undersigned, with hire wear.
All garments remain our property at all times and are provided for the duration of the hire period stated on the order form only. It is your responsibility to take reasonable care of the garments.
GARMENTS
All garments supplied by us shall be in good condition and free from defects and staining, having passed through our various inspection and processing facilities. However, due to dry cleaning there may be slight shading differences in garments, e.g. for large wedding parties.
We stock the largest range of sizes in the formal hire wear market and can therefore cater for almost every customer. Please note, however, that we cannot carry out alterations to any garment.
We do not accept responsibility for the fit of garments if orders have been completed incorrectly. All telephone orders will be read back to you as we enter then onto our system. It is the responsibility to check these details are correct, as we do not accept liability for telephone orders after we read them back to you.
We reserve the right to substitute to the nearest half size as follows:-

DELIVERIES
For the majority of locations, outfits will be delivered hanging in our own van. These deliveries will be made a minimum of 1 day before a function date (based on a Saturday function), providing we have a 50% deposit of total invoice, paid upon receipt of order.
No suits will be supplied without a deposit had been paid.
No order will be accepted unless a function date/address/time is stated in the order form.
Orders received within 20 days of a function date may need to be dispatched by a third party carrier, and will incur an additional charge.
We do not take responsibility of any failure to deliver on time by any third party carrier.
While we make every effort to deliver any garments 1 day before a function date, the hire period is deemed to start at 9am on any function date.
All garments will be picked up 1 day after the function date.
We will come out to one nominated address to measure all people wishing to hire a suit. This will happen approx.10 weeks before the function date
Changes to original order
We will charge £1 per garment for any changes made against the original order within one month of your fitting date, and £2 per garment for any changes made against the original order within one week of your fitting date.
Cancellation of order
In the event of any order been cancelled within 20 days of the function date, you will be expected to pay the full cost of each suit ordered.
Customer fittings
Customer fittings can be arranged for the seventh day before the function date, but no later as we will need to send off for replacement garments should there be any size issues. If you do not do this we do not accept responsibility to provide replacement garments.
All garments must be inspected by you the customer on your fitting day as replacements can not be ordered after this date.
NB. All children's waistcoats are backless to facilitate the successful fitting of a wide range of shapes and sizes for the same age/height.
Care of Garments and accessories
You agree to treat the garments and accessories with reasonable care.
Please take particular care with Top Hats. Under no circumstances should they be thrown in the air.
Please be advised that the Skean Dhu and Kilt pin, both supplied with highland wear outfits, has ( in the case of the Skean Dhu ) a real blade and must not be removed from its sheath and (in the case of the Kilt pin) a sharp point and must not be removed from the Kilt.
As the Skean Dhu and Kilt pin are decorative accessories only, we do not accept any responsibility for any damages, costs, claims, losses, expenses or liability whatsoever incurred by us, and howsoever arising as a result of misuse of the Skean Dhu and/or Kilt pin and you will indemnify us for any such damages, costs, claims, loses, expenses or liabilities. You agree for the purposes of the Unfair Contract Terms Act 1977 that this liability exclusion is reasonable in the circumstances. In the event that this condition is deemed unenforceable, that shall not affect the validity or enforceability of any other provision of this contract, it been the intention of you and us that all conditions of this agreement shall be valid and enforceable.
Return of garments
All garments shall be picked up from one nominated address the next day after the function date, Failure to have all garments ready for collection on this date, and agreed time will result in a surcharge of £6 per suit per day. There is no exception to this condition.
Shirts
All shirts will be measured and fitted by the Simplysuits representative, and agreed with the customer for comfort. Any changes to a shirt order will incur a £15 charge.
Accidental damage waiver
You will pay a premium of £5 for the accidental damage waiver and we will wave all charges that would normally arise following accidental damage to any or all of the garments provided that they are being used appropriately (with the exception of top hats, which are not covered by this waiver)
The waiver does not cover garments, which have in our opinion been damaged through inappropriate use.
Please remember that any personal insurance you may already hold does not cover the garments and accessories supplied by Simply suits LTD
We reserve the right to charge for any garment and/or accessory which has been lost or stolen
Miscellaneous
This contract is governed by English law and English courts shall have complete jurisdiction.
